Terms of Service for Sperminal

Acceptance of Terms

By downloading, installing, or using the Sperminal mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

About Nigelware

Nigelware is the developer and owner of Sperminal. Sperminal is a personal sperm-health pipeline tracker that simulates the approximately 90-day behavioural impact window of spermatogenesis (~74 days of sperm production plus epididymal transit) and helps users log daily lifestyle habits.

Eligibility

You must be at least 18 years old to use Sperminal. By using the App, you represent and warrant that you meet this age requirement.

License to Use

Subject to these Terms, Nigelware grants you a limited, non-exclusive, non-transferable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

Permitted Uses

You may:

• Log daily positive and negative lifestyle inputs that affect your pipeline
• View your simulated cohorts, scores, history, and trajectory
• Receive local reminder notifications
• Share progress snapshots through the standard iOS share sheet
• Customize app settings according to your preferences
• Provide feedback to help improve the App

Prohibited Uses

You may not:

• Modify, reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose
• Distribute, rent, lease, or sublicense the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App in any way that violates applicable laws or regulations
• Rely on the App as a substitute for professional medical advice, diagnosis, or treatment

Medical Disclaimer

Your Data

You retain ownership of all logs, simulation data, and personal information you enter into the App. All data is stored locally on your device. Deleting the App will permanently remove all associated data. See the Privacy Policy for details on how data is handled.

Sharing Features

If you choose to share progress snapshots from Sperminal (for example with a partner), you are solely responsible for what you share, with whom, and through which channel. Once content leaves the App via the iOS share sheet, Nigelware has no control over it and assumes no responsibility for its use, storage, or distribution.

Your Content

Any feedback, suggestions, or other communications you provide regarding the App may be used by Nigelware without restriction or compensation to improve the App.

App Availability and Updates

• The App is provided "as is" and "as available"
• We may update, modify, or discontinue the App at any time without notice
• Updates may be required for continued use of the App
• We do not guarantee the App will be available at all times or free from interruptions

Intellectual Property

The App and all its content, features, and functionality (including the simulation engine, decay model, copy, and visual design) are owned by Nigelware and are protected by international copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the fullest extent permitted by law:

• Nigelware shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App (if any)
• We do not warrant that the App will be error-free or uninterrupted
• We are not responsible for any data loss resulting from device failure, App deletion, or other circumstances beyond our control
• We are not liable for any health, fertility, relationship, or financial outcomes related in any way to your use of the App

Apple-Specific Terms

For users who download the App through the Apple App Store:

• These Terms are between you and Nigelware only, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• Apple is a third-party beneficiary of these Terms and may enforce them

Termination

These Terms remain in effect until terminated by either you or Nigelware. You may terminate by deleting the App from your device. Nigelware may terminate your access to the App at any time for any reason.

Updates and Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting updated Terms at this URL or within the App. Your continued use of the App constitutes acceptance of any changes.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nigelware regarding the use of the App.
