These Terms of Service ("Terms") govern your use of the Dislex mobile application ("App") operated by Nigelware ("we," "our," or "us").
Acceptance of Terms
By downloading, installing, or using Dislex, you agree to these Terms. Dislex is intended to be set up and managed by a parent or guardian; if you allow a child to use it, you accept these Terms on their behalf. If you do not agree, do not use the App.
About Dislex
Dislex is a phonics-based reading game for young children, including children with dyslexia. It teaches letter sounds, blending, and decoding through structured, playful practice with a friendly mascot named Pip. It is a learning and practice aid for use at home.
License to Use
We grant you a limited, non-exclusive, non-transferable license to use Dislex for personal, non-commercial, family use, in accordance with these Terms and Apple's Licensed Application End User License Agreement (the standard Apple EULA).
Permitted Uses
You may use Dislex to:
Create one or more child profiles and let your child play through the reading levels, worlds, and stories
Adjust reading-support settings (font, color, sound, motion) to suit your reader
View progress in the grown-up area
Make the optional one-time purchase to unlock the full App
Prohibited Uses
You may not:
Use the App for any illegal or unauthorized purpose
Reverse engineer, decompile, modify, copy, or distribute the App or its content (including its artwork, audio recordings, stories, and lessons)
Interfere with the App's functionality, security, or integrity
Resell, sublicense, rent, or commercially exploit the App
Educational Tool — Not Medical or Diagnostic
IMPORTANT: Dislex is a learning and practice game, not a medical device or professional service.
Dislex does not diagnose, assess, treat, cure, or prevent dyslexia or any other reading difficulty, learning disability, or medical or psychological condition.
It is not a substitute for professional evaluation, instruction, therapy, or care from a qualified teacher, reading specialist, psychologist, or physician.
The word "dyslexia" describes the readers the App is designed to support; it is not a claim of clinical efficacy.
Reading progress depends on many factors outside our control, and we make no guarantee of any particular educational outcome.
If you have concerns about your child's reading, speech, hearing, or development, please consult a qualified professional.
Children and Parental Supervision
Dislex is designed for children and should be set up and supervised by a parent or guardian.
Purchases and grown-up areas are placed behind a parental gate. You are responsible for keeping that gate, your device, and your Apple ID secure so children cannot make unintended purchases.
You are responsible for supervising your child's use of the device and the App.
Fees and Payment
Dislex is free to download and includes free content. The full App can be opened with a single one-time purchase ("Unlock Everything"), shown on the App Store listing.
This is a one-time, non-consumable purchase — not a subscription. There are no recurring charges.
The purchase supports Apple Family Sharing.
All payments are processed by Apple. Pricing is set through the App Store and may change. Refunds are handled by Apple under the App Store's refund policies.
Your Data
All profiles, progress, and settings are stored only on your device. You own them; we do not access them. See our Privacy Policy.
Because data is stored on-device only, deleting the App deletes its data. You are responsible for any data loss resulting from device failure or removing the App.
App Availability and Updates
The App is provided "as is" and we do not guarantee uninterrupted availability.
We may update, modify, or discontinue features at any time, and may release new versions.
App functionality depends on iOS / iPadOS compatibility and your device's capabilities.
Intellectual Property
Dislex, including its name, design, mascot (Pip), illustrations, audio recordings, stories, and lessons, is owned by Nigelware and protected by copyright and other laws.
You may not copy, reproduce, reverse engineer, or distribute any part of the App.
Our trademarks and logos may not be used without written consent.
Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, consequential, or punitive damages arising from use of the App.
Our total liability shall not exceed the amount you paid for the App in the past 12 months.
We do not warrant that the App will be error-free, secure, or meet all your requirements, or that any particular educational result will be achieved.
Indemnification
You agree to indemnify and hold harmless Nigelware from any claims, damages, or expenses arising from your violation of these Terms or applicable laws, or your misuse of the App.
Apple-Specific Terms
These Terms are between you and Nigelware, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide support or maintenance for the App.
If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims should be directed to Nigelware.
Apple is not responsible for addressing product-liability or third-party claims related to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Termination
We may terminate your license for violation of these Terms.
You may stop using the App at any time by deleting it from your device.
Sections regarding liability, indemnification, and intellectual property survive termination.
Changes to These Terms
We may modify these Terms at any time. The current version will always be available at this URL.
Material changes will be communicated through the App or our website.
Continued use of the App after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of California, and both parties consent to the exclusive jurisdiction and venue of such courts.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nigelware regarding the App and supersede all prior agreements.
