Description of Service
UpKeep Pro is a home maintenance scheduling and tracking application. The App automatically generates a personalized maintenance schedule based on your home details and move-in date, sends reminders for upcoming tasks, and allows you to log completions with optional photos and cost records.
License to Use
Subject to these Terms, Nigelware grants you a limited, non-exclusive, non-transferable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.
Permitted Uses
You may:
Use the App to create and manage home maintenance schedules
Log task completions, attach photos, and record costs
Configure notification preferences and reminder settings
Use home screen widgets to view upcoming maintenance tasks
Provide feedback to help improve the App
Prohibited Uses
Important: The following activities are strictly prohibited and may result in termination of your license to use the App.
You may not:
Modify, reverse engineer, or decompile the App
Use the App for any commercial purpose, including property management services
Distribute, rent, lease, or sublicense the App
Remove or alter any copyright, trademark, or other proprietary notices
Use the App in any way that violates applicable laws or regulations

Your Content
You retain ownership of all data you enter into the App, including home information, maintenance records, photos, and cost data. This data is stored locally on your device. Any feedback, suggestions, or other communications you provide regarding the App may be used by Nigelware without restriction or compensation to improve the App.
App Availability and Updates
The App is provided "as is" and "as available"
We may update, modify, or discontinue the App at any time without notice
Updates may be required for continued use of the App
We do not guarantee the App will be available at all times or free from interruptions
Maintenance Schedule Disclaimer
Informational Purpose: The maintenance schedules generated by UpKeep Pro are general recommendations based on common home maintenance best practices. They are not a substitute for professional home inspection or contractor advice. Always consult qualified professionals for significant maintenance or repair work. Nigelware is not responsible for any property damage or personal injury resulting from maintenance activities performed based on the App's recommendations.
Intellectual Property
The App and all its content, features, and functionality are owned by Nigelware and are protected by international copyright, trademark, and other intellectual property laws.
Limitation of Liability
To the fullest extent permitted by law:
Nigelware shall not be liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the App
We do not warrant that the App will be error-free or uninterrupted
We are not liable for any data loss resulting from device failure, App removal, or software updates
We are not responsible for any property damage or costs arising from following maintenance recommendations
Apple-Specific Terms
For users who download the App through the Apple App Store:
These Terms are between you and Nigelware only, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support for the App
Apple is a third-party beneficiary of these Terms and may enforce them
Termination
These Terms remain in effect until terminated by either you or Nigelware. You may terminate by deleting the App from your device. Please note that deleting the App will permanently remove all locally stored data, including your home information, maintenance history, and photos. Nigelware may terminate your access to the App at any time for any reason.
Updates and Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting updated Terms within the App. Your continued use of the App constitutes acceptance of any changes.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nigelware regarding the use of the App.
