These Terms of Service ("Terms") govern your use of the Mini Garden Coach mobile application ("App") operated by Nigelware ("we," "our," or "us").
Acceptance of Terms
By downloading, installing, or using the Mini Garden Coach app, you agree to be bound by these Terms. If you do not agree, do not use the App.
About Nigelware
Nigelware develops mobile applications for everyday people. Mini Garden Coach is a beginner-friendly gardening app that hands you a week-by-week plan for a small indoor or balcony garden, with a photo journal, harvest log, and gentle weekly nudges along the way.
License to Use
We grant you a limited, non-exclusive, non-transferable license to use Mini Garden Coach for personal, non-commercial purposes in accordance with these Terms and Apple's Licensed Application End User License Agreement.
Permitted Uses
You may use Mini Garden Coach to:
Complete onboarding and receive recommended garden templates based on your space, light, and time
Start one or more gardens and track week-by-week tasks, milestones, and progress
Capture or import photos for the photo journal
Log harvests as you pick what you grew
Submit weekly feedback to help us improve the App
Use the troubleshooter and care tips for guidance
Use the shopping list, mark items as purchased, share or export the list, and tap retailer links to find products
Receive and manage local weekly notifications, with reminder hour, sound, and reminders toggle controlled in Settings
Sync your gardens, photos, and progress across your own iPhones and iPads via your private iCloud account
Prohibited Uses
You may not:
Use the App for any illegal or unauthorized purpose
Use the App to provide medical, agricultural, or food-safety advice to others
Attempt to reverse engineer, modify, or distribute the App
Interfere with the App's functionality, security, or integrity
Capture or upload photos that are harmful, offensive, or violate the rights of others
Violate any applicable privacy or consumer-protection laws or regulations
User Responsibilities
You must:
Comply with all applicable laws and regulations in your jurisdiction
Maintain appropriate security on your device, including passcode and iCloud account security
Verify the safety and identity of any plant before consuming it
Use your own judgment when following the App's gardening guidance
Not rely on the App as a substitute for professional horticultural, agricultural, or medical advice
Your Content and Data Ownership
You retain ownership of all gardens, photos, harvests, and feedback you create using the App
We do not access, process, or claim ownership of your content
You are responsible for managing your iCloud backup and for any data loss resulting from device failure, App deletion, or iCloud changes
Any feedback or suggestions you send us regarding the App may be used by Nigelware without restriction or compensation to improve the App
App Availability and Updates
The App is provided "as is" and we do not guarantee uninterrupted availability
We may update, modify, or discontinue features at any time
App functionality depends on iOS compatibility, device capabilities, and your iCloud account status
We reserve the right to release new versions and deprecate older versions
Gardening Guidance Disclaimer
IMPORTANT: Mini Garden Coach provides general guidance for beginners, not professional advice:
Garden plans, weekly tasks, milestones, plant care tips, and the troubleshooter are general guidance, not professional horticultural, agricultural, or scientific advice
Plant outcomes depend on many factors outside our control — including light, temperature, humidity, water and soil quality, plant variety, and your specific environment
We do not guarantee that any plant will germinate, grow, or produce a harvest
We are not responsible for plant losses, time spent, or expenses incurred while following the App's guidance
For region-specific advice, consult a local garden center, your nearest cooperative extension office, or a qualified horticulturalist
Edible Plants Disclaimer
IMPORTANT: Some templates include edible plants. Verify before eating:
You are solely responsible for verifying that anything you grow and eat is the plant you intended, was grown using safe materials (soil, water, fertilizers, pots), and is free from contamination, mold, or pests
Do not eat any plant that looks, smells, or tastes wrong, or that you are not 100% sure is safe
The App does not perform plant identification, soil testing, or food-safety analysis
If you have a known allergy to a plant, do not grow or consume it
When in doubt, consult a qualified professional
Photos and Camera
If you grant camera or photo library permission, photos you capture or import are stored locally on your device and synced to your private iCloud database. We do not transmit, back up, or analyze your photos. Photos are deleted when you delete the garden they belong to or remove the App from your device. Sync copies in iCloud follow Apple's normal iCloud retention rules.
Outbound Links and Affiliate Programs
The App may include links to third-party retailers for shopping list items. Tapping a link opens that retailer's site inside the App's in-app browser. Where applicable, Nigelware participates in affiliate programs (such as the Amazon Associates Program) and may earn a commission on purchases. This never changes the price you pay. Once you are on a retailer's site, the retailer's terms and privacy policy apply. We are not responsible for products, prices, availability, or transactions on third-party sites.
Intellectual Property
The Mini Garden Coach app, including its design, copy, illustrations, plant artwork, and garden templates, is owned by Nigelware
You may not copy, reproduce, reverse engineer, or distribute any part of the App
Our trademarks and logos may not be used without written consent
Fees and Payment
The App may be offered as a one-time purchase, subscription, or free trial. The current pricing model is shown on the App Store listing
Pricing is determined by Apple's App Store and subject to change
Subscriptions, where offered, automatically renew unless cancelled at least 24 hours before renewal
Refunds are handled according to Apple's App Store refund policies
We reserve the right to modify pricing with notice to existing users
Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, consequential, or punitive damages arising from app use
Our total liability shall not exceed the amount you paid for the App in the past 12 months
We do not warrant that the App will be error-free, secure, or meet all your requirements
We are not responsible for data loss, unauthorized access, or security breaches of your device or iCloud account
We are not responsible for plant losses, garden outcomes, or expenses incurred while following the App's guidance
Indemnification
You agree to indemnify and hold harmless Nigelware from any claims, damages, or expenses arising from:
Violation of these Terms or applicable laws
Your use of the App's gardening guidance
Your consumption of plants you grew using the App
Improper use of photos, harvests, or other content created in the App
Unauthorized use or distribution of the App
Apple-Specific Terms
Apple Inc. is not responsible for the App or any claims related to it
In case of App failure to conform to warranty, contact Nigelware, not Apple
Apple has no obligation to provide support or maintenance for the App
Apple is not responsible for product liability claims related to the App
Apple is a third-party beneficiary of these Terms regarding your use of the App
These Terms are between you and Nigelware, not Apple
Termination
We may terminate your access to the App for violation of these Terms
You may stop using the App at any time by deleting it from your device
Upon termination, all licenses granted to you will cease immediately
You remain responsible for any data stored locally or in your iCloud account, and for compliance with applicable laws
Sections regarding liability, indemnification, and intellectual property survive termination
Updates and Modifications to Terms
We reserve the right to modify these Terms at any time
Material changes will be communicated through the app or our website
Continued use of the App after changes constitutes acceptance of new Terms
The current version will always be available at this URL
Governing Law and Jurisdiction
These Terms are governed by the laws of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of California. Both parties consent to the exclusive jurisdiction and venue of such courts.
Dispute Resolution
Before filing any legal claim, parties agree to attempt good-faith negotiation for 30 days
Either party may pursue resolution through small claims court for qualifying disputes
Each party bears its own legal costs unless otherwise awarded by a court
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nigelware regarding use of the App and supersede all prior agreements and understandings.
