Acceptance of Terms
By downloading, installing, or using the Love Hunt mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
About Nigelware
Nigelware is the developer and owner of Love Hunt. We are committed to creating engaging mobile applications that help people express love and create memorable experiences for their partners, friends, and family.
Description of Service
Love Hunt is a romantic scavenger hunt maker that allows users to:
Create custom scavenger hunts with clues, hints, photos, and audio recordings
Publish hunts and share them with recipients via a unique link
Play and complete scavenger hunts created by others
License to Use
Subject to these Terms, Nigelware grants you a limited, non-exclusive, non-transferable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.
Subscriptions and Purchases
Free Use: You may create and publish your first hunt for free
Subscription: A subscription is required to publish additional hunts beyond the first
Payment: All payments are processed through the Apple App Store. Subscription terms, pricing, and renewal are governed by Apple's terms
Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period
Refunds: Refund requests must be directed to Apple through their standard refund process
User-Generated Content
Your Responsibility
You are solely responsible for the content you create and share through the App, including text, photos, and audio recordings. By publishing a hunt, you represent and warrant that:
You own or have the right to use all content included in your hunt
Your content does not infringe on any third party's intellectual property rights
Your content does not contain illegal, harmful, threatening, abusive, or otherwise objectionable material
Your content does not violate any applicable laws or regulations
Important: Published hunts are accessible to anyone with the share link. Do not include sensitive personal information, private data, or content you do not want others to see.
Content Removal
Published hunts automatically expire and are removed from our servers after 30 days. Nigelware reserves the right to remove any content that violates these Terms without notice.
License to Content
By publishing a hunt, you grant Nigelware a limited, non-exclusive license to store, transmit, and display your content solely for the purpose of delivering the hunt to your intended recipients. This license expires when the hunt is removed from our servers.
Permitted Uses
You may:
Create scavenger hunts for personal, non-commercial purposes
Share hunts with friends, family, and partners
Play and complete hunts shared with you
Provide feedback to help improve the App
Prohibited Uses
Important: The following activities are strictly prohibited and may result in termination of your license to use the App.
You may not:
Modify, reverse engineer, or decompile the App
Use the App for any commercial purpose without prior written consent
Use the App to stalk, harass, or intimidate others
Attempt to gain unauthorized access to any part of the App or its systems
Use automated means to interact with the App or its services
Circumvent any subscription or usage restrictions
Remove or alter any copyright, trademark, or other proprietary notices
Hunt Expiration
30-Day Expiration: Published hunts automatically expire 30 days after publication. After expiration, the hunt content is permanently removed from cloud storage and will no longer be accessible to recipients. Local copies of hunts on your device are not affected by expiration.
App Availability and Updates
The App is provided "as is" and "as available"
We may update, modify, or discontinue the App at any time without notice
Updates may be required for continued use of the App
We do not guarantee the App will be available at all times or free from interruptions
We are not responsible for hunts that become inaccessible due to service interruptions
Intellectual Property
The App and all its features, design, and functionality (excluding user-generated content) are owned by Nigelware and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of the content you create within the App.
Limitation of Liability
To the fullest extent permitted by law:
Nigelware shall not be liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the App or subscription in the past 12 months
We do not warrant that the App will be error-free or uninterrupted
We are not responsible for the content of hunts created by other users
We are not liable for any loss of data, including hunt content, due to technical issues or expiration
Indemnification
You agree to indemnify and hold Nigelware harmless from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.
Apple-Specific Terms
For users who download the App through the Apple App Store:
These Terms are between you and Nigelware only, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support for the App
Apple is a third-party beneficiary of these Terms and may enforce them
Termination
These Terms remain in effect until terminated by either you or Nigelware. You may terminate by deleting the App from your device. Nigelware may terminate your access to the App at any time for violation of these Terms. Upon termination, any published hunts will remain accessible until their expiration date.
Updates and Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting updated Terms within the App. Your continued use of the App constitutes acceptance of any changes.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nigelware regarding the use of the App.
